Police: No evidence that reported assault occurred at Billings Walmart

BILLINGS - It appears an assault of a 52-year-old man in front of the Billings Heights Walmart on Feb. 2 may not have happened.

Billings Police Sgt. Shane Winden said Monday a follow-up investigation has shown no evidence to support the claim.

"We don't have any evidence this occurred," he said. "There's no video footage from Walmart showing the assault."

Winden said the man was intoxicated and was near the Walmart to purchase cigarettes. He lost his wallet and walked home where he told a neighbor of the alleged assault.

That neighbor phoned police and reported the situation.

"It was unclear at the time where it occurred," Winden said. "He alluded it happened in front of the store."

Police sent media a press release the following day and reported two male suspects mugged the man. 

The man, who was not identified, did not have any injuries, Winden said. Walmart employees voiced concerns that the report was not true.

Q2 News followed up and officials said there was no reason to believe the report was false.

Winden said further investigation found the case had no merit.

It's unlikely the man will be charged with any crime because he did not call in the assault.
