Missoula man facing assault charges

MISSOULA -- A 52-year-old Missoula man was charged Sunday with felony assault with a weapon.

Court documents state that Kevin S. Haggard allegedly struck his neighbor, Theresa Stephens, in the head with a metal rake and pieces of wood during a dispute on the morning of Sept. 10.

When a Missoula County Sheriff’s deputy responded to reports of a disturbance, he said that Stephens had blood on her face and ear, as well as a small abrasion on her elbow, according to court documents.

Haggard shared a property line with Stephens, who said they had a confrontation when Haggard began piling wood against their shared fence line. Court documents state that the wood pile had previously knocked down the fence, Stephens said, but Haggard had repaired it.

Haggard began piling wood against the fence line again recently, and Stephens said in court documents that she told him the arrangement would not work. On Sunday morning, Stephens used a rake to push the wood pile farther back onto Haggard’s property.

As that was happening, Haggard grabbed the rake Stephen’s was using, and hit her in the head with it, according to court documents, and also hit her multiple times with a piece of wood.

Judge Marie Anderson set Haggard’s bail at $25,000 in Justice Court on Monday. His next court appearance is Sept. 25.
