Gianforte argues against mugshot and fingerprints for assault charge

Congressman-elect Greg Gianforte has filed a motion to avoid having his mug shot and fingerprints taken.

The Bozeman politician pleaded guilty to misdemeanor assault for the attack on The Guardian's Ben Jacobs on Monday.

After his sentencing, Gianforte was told to go to the Gallatin County Detention Center to have his mug shot taken and fingerprints recorded.

Gianforte and his legal team said he is not legally required to do either and filed a motion Friday afternoon to prevent the instruction.

The documents argue that Gianforte should not be required to follow the order because he was never arrested, was not charged with a felony and had his case solely dealt with in Justice Court.

Mug shots are not released to the public in Gallatin County.
