Montana Cannabis Industry Association files lawsuit against state

The Montana Cannabis Industry Association has filed a lawsuit seeking to force the state Department of Health and Human Services to begin immediate processing and issuing of medical marijuana cards.

Voters approved relaxing and rolling back restrictions on medical marijuana earlier this month, but the language in the ballot measure means a rollback on the strict three patient limit wouldn’t take effect until next summer.

Authors of the ballot measure have said the date the law is set to take effect is the result of clerical error, and that changes should take effect immediately.

The legislature passed the three patient limit back in 2011, but it was tied up in court for five years before taking effect at the end of August this year.
