HELENA - The Montana Supreme Court has denied a constitutional challenge of the state's medical marijuana law.

The motion, filed by the Montana Cannabis Industry Association, asked the Supreme Court to reconsider a recent decision overturning significant parts of a lower court's injunction against the law.

The Montana Cannabis Industry Association says in a news release that the Montana Department of Public Health and Human Services will now send notice to nearly 5,500 of the state's 8,849 patients cancelling their licensed medical marijuana provider and giving them 30-day notice to either find a different provider or begin growing marijuana for themselves.

But, the issue may not be over yet as Initiative Referendum 124 is on the ballot this year, which would allow voters to either keep the current medical marijuana law or overturn it.
