KALISPELL- A Flathead District Court Judge has dismissed a petition filed by Justine Winter claiming that her counsel was ineffective during her deliberate homicide trial.
The decision released by Judge Katherine Curtis, states Winter's petition was not signed or verified. Curtis also says a petition needs to identify all facts supporting the grounds for relief set forth in the petition and have attached affidavits to back up those claims.
Winter claimed in her petition that her attorney failed to preserve the right of appeal.
Winter was convicted in February of 2011 on two counts of deliberate homicide for intentionally driving her vehicle head on into another car, killing a pregnant mother and her 13-year-old son.
