Judge hears statements in Flathead boat crash case involving Barkus, Rehberg

KALISPELL - The Flathead County Attorney says individual privacy outweighs the needs of full disclosure in the case of the Flathead Lake boat crash involving Greg Barkus and Senatorial candidate Denny Rehberg.

Ed Corrigan made the statement Tuesday in a court filing to District Judge John McKeon after a request by Citizens for Responsibility and Ethics in Washington, DC that pre-sentence investigation documents be made available to the public.

Corrigan stated that he did not object to an edited version of the documents which would not include any personal information on Rehberg, Barkus or any of the boat passengers. Corrigan also said an edited version should exclude any description of alcohol or chemical use by Barkus.

Prosecutors said Barkus has a blood alcohol content of .16 the night of the boat crash on Aug. 27, 2009 that happened as Barkus, Rehberg and others were boating home from a campaign function earlier that night.

Barkus' attorney, Todd Glazier, has already filed for a 30-day continuance in this matter. McKeon has yet to make a ruling on this request, but was expected to do so this week.
