Court battle wages on in M & M sale

BUTTE - More documents were filed in court Monday involving the sale of items from the M & M Bar and Cafe in Butte.

A motion was filed in Gallatin County District Court Monday afternoon by a former bookkeeper of the M & M, requesting an injunction on the building and to stop the scheduled sale of memorabilia. The judge has yet to rule on the motion.

These latest filings stem from a lawsuit by the former bookkeeper, Michael Siemers, claiming principal M & M owner Dan Klemann breached a management and loan agreement. Last week, a creditor in the case obtained a temporary restraining order from a Butte District judge that prevents anyone from removing or selling items in the historic tavern. The bar closed its doors in September following a dispute over unpaid utility bills and claims from employees of not being paid.
